Stack
WooCommerce + Dokan (tickets/fulfillment), Zoom/meeting tools (live), BuddyBoss (community), WP Fusion → ActiveCampaign (emails/tags), AffiliateWP (referrals), GamiPress (visual badges only).
These terms complement our Community Guidelines, Privacy Policy, and Prohibited & Restricted Items. If there’s a conflict, these Instructor Terms control for instruction.
1) Role & Eligibility
- Platform role. CLIMB provides event tools and community space; you run your instruction.
- Eligibility. 18+ (or local age of majority). Provide accurate account info and required tax forms (W-9/W-8BEN) before payouts for ticketed events.
- Approval. Instructor status requires application and adherence to these terms and Community Guidelines.
- Co-instructors & guests. You may invite co-instructors/guests but remain responsible for accuracy, safety, conduct, and IP compliance. Disclose guest names/roles in the listing.
2) Event Accuracy & Accessibility
- Clear details. Title, date, timezone, duration, capacity, prerequisites, materials list/kits, and delivery method (Zoom/link) must be accurate and on time.
- Photos & text. True-to-life photos; alt text on images; the first 1–2 sentences explain who it’s for, what they’ll learn, and what’s included.
- Measurements & materials. Use plain text for sizes (in + cm). Disclose scents, allergens, and tool/heat/chemical use.
- Accessibility baseline. Offer a brief live verbal description of key visuals; avoid auto-play audio or flashing effects; provide materials list in text; caption replays when offered.
3) Tech Requirements, Attendance Proof & Data Retention
- Minimum tech. Zoom-capable device and stable internet; publish requirements in your listing.
- Attendance proof. CLIMB/Instructor may retain join/leave timestamps and chat receipts solely for support and dispute resolution.
- Retention limits. Attendance logs/chat receipts kept up to 180 days, then purged. Replays are removed after the stated access window.
4) Safety, Minors & Waivers
- Safety first. Choose projects appropriate for remote instruction. List PPE, ventilation, heat/tool cautions, and workspace needs.
- Minors. No enrollment of minors without verifiable guardian consent and compliance with local law. No unsupervised 1:1 instruction with minors on CLIMB tools. Collect minimal minor data.
- Waiver. For higher-risk sessions, require an Assumption-of-Risk/Participation acknowledgment at checkout or via pre-class form.
- Insurance (recommended). For kilns, torches, solvents, sharp tools, etc., we recommend appropriate liability coverage; CLIMB is not your insurer.
5) Tickets, Refunds, Transfers & Cancellations
- Default participant refunds (unless your listing states otherwise):
- Cancel ≥ 7 days before start → 100% refund.
- Cancel 2–6 days before → 50% refund.
- Cancel < 48h or no-show → No refund (credit at your discretion).
- One complimentary transfer. One date transfer if requested ≥ 48h before start, subject to seat availability; later transfers at your discretion.
- Instructor cancellation/low enrollment. Notify promptly. Offer full refund or a new date; attendees may choose refund instead of reschedule.
- Digital items & replays. Non-refundable once accessed/streamed, except failed delivery or duplicate purchase.
- Materials kits. Publish ship-by date and costs. Unopened kits: refundable less shipping; opened/used kits: non-refundable unless defective. Shipping delays outside your control may result in reschedule or kit-only refund at CLIMB’s discretion.
6) Delivery, Replays & Recording
- On-time delivery. Share meeting links ~24h ahead (and 1h reminder). Start/end on schedule when possible.
- Recording default. Only the Instructor demo is recorded by default. Do not record participants without explicit prior consent.
- Names/faces & chat. Do not include attendee names/faces or chat handles in replays without explicit consent; redact or disable public chat in the recording.
- Replay window. If offered, replays are accessible for [14–30 days] from posting. If a platform outage blocks access >24h, CLIMB may extend the window or offer credit.
- IP & rights. You retain IP in your instructional materials. You grant CLIMB a non-exclusive, worldwide license to host/stream/display your submitted instructional content to enrolled participants and for reasonable promotion of the event.
- Photo & Content Rights: Images and descriptions belong to their makers. Reuse without permission is not allowed. Upload resized images only (1500–2000 px wide).
- Third-party assets. Use only assets you have rights to. Disclose affiliate links where used.
7) Promotions, Price Parity, Referrals & Emails
- Price parity. Your public price on CLIMB must be no higher than your lowest public price elsewhere for the same event.
- No off-platform diversion. Do not steer attendees to complete payment off CLIMB or harvest emails for off-platform marketing unless they explicitly opted in.
- Affiliate links (AffiliateWP). Self-referrals, coupon stacking to inflate commissions, or misleading incentive posts are prohibited; CLIMB may void commissions and suspend access for abuse.
- Emails & tags. WP Fusion applies tags on event actions (e.g., ticket purchased, event completed) which trigger emails in ActiveCampaign per our Privacy Policy. Do not export community emails or spam members.
- Badges. GamiPress badges recognize contribution; they have no cash value.
8) Conduct, Community & Support SLA
- Inclusive facilitation. Consent-first, no harassment or discrimination. We may moderate chats/forums. Violations may result in removal and program suspension.
- Support SLA. Respond to participant messages within 2 business days. Unresolved cases may be escalated via /general-support.
- Accessibility accommodations. We make reasonable accommodations on request. If a participant can’t meaningfully access after timely request, we may offer replay, transfer, or refund at our discretion.
9) Data, Privacy & Security
- Use of attendee data. Use data only to run the purchased event. No off-platform marketing unless the attendee explicitly opted in.
- Security. Keep credentials safe. You’re responsible for activity under your account.
- DMCA & counter-notice. Report alleged infringement via /ip-takedown. If your replay/material is removed, you may submit a counter-notice; we may keep content offline during review.
10) Outages & Force Majeure
- Neither CLIMB nor Instructors are liable for delays/failures from events beyond reasonable control (e.g., widespread outages, disasters).
- If an outage prevents delivery, offer (a) reschedule within 30 days, or (b) a credit equal to the ticket price.
11) Payments, Payouts & Taxes (summary)
- Tickets & payouts. Ticket sales process via Woo; payouts are released to your connected Stripe/PayPal account on [choose: rolling 7–10 days / bi-weekly / monthly] after event completion, subject to fraud/chargeback holds and required tax docs.
- Minimum payout & negatives. Minimum payout $[X]. Negative balances (refunds/chargebacks/fees) are netted from future payouts.
- Taxes. You are responsible for applicable taxes. Where marketplace-facilitator laws require CLIMB to collect/remit certain taxes, we will disclose and adjust payout statements.
- Chargebacks. Provide timely evidence (attendance logs, chat receipt, recording of demo) to respond to disputes. Losses/fees attributable to your transactions may be deducted from payouts.
12) Governing Law, Limitation of Liability & Indemnity
- Governing law/venue. These terms are governed by the laws of [Your State/Country]; exclusive venue in [Your County/City].
- Limitation. To the maximum extent permitted, no indirect/special/consequential damages. Our total liability to you is limited to the greater of (a) fees paid by you to CLIMB in the 3 months before the claim, or (b) $100.
- Indemnity. You’ll indemnify CLIMB from claims arising out of your events, materials, or misuse of the platform.
13) Updates & Acceptance
- Updates. We may update these terms. We’ll post the new date/version above and, when material, notify you by email or in-app message.
- Acceptance logging. By ticking “Accept Instructor Terms,” you agree to this version. We record
