Marketplace & Freelancer Terms
- Freelancers are independent; CLIMB is the platform.
- Write scope, timeline, milestones, and revision limits on the listing.
- Payments/fees run through the site; taxes and forms (W-9/W-8BEN) are required for payouts.
- Refunds/cancellations follow the policy shown on the listing (Standard/Strict/Digital).
- Recording live sessions requires consent; enable captions and keep data safe.
- Badges are recognition only; referral links require disclosure.
1) Who we are
CLIMB Crafts (“CLIMB,” “we,” “us”) runs an online marketplace for handmade goods, classes, and freelance craft services. These Terms apply to Freelancers who offer services and to Clients who hire them on CLIMB.
2) Independent contractor status
Freelancers are independent contractors. CLIMB is not an employer, agent, or joint venture partner. Freelancers set their rates, policies, schedule, and are responsible for taxes and compliance.
3) Eligibility & accounts
- 18+ and able to contract; follow the Community Pledge and Guidelines.
- Profiles/listings must be accurate. We may suspend accounts for safety/legal reasons.
4) Listings, quotes, and scope of work
Offer services via fixed-price listings or custom quotes converted to orders. State deliverables, timeline, milestones (if any), inclusions/exclusions, and revision limits. Changes beyond scope require a new quote/order.
5) Communication & records
Use CLIMB messages and order notes when feasible—this protects both sides and creates a record for Support. Don’t request or share card numbers. No off-platform solicitation.
6) Scheduling, live sessions, and recordings (if used)
- Calendly ↔ Zoom: enable Waiting Room, passcode, and mute on entry.
- Accessibility: enable live captions; share materials lists in text; describe key visuals when relevant.
- Recording requires consent. If recording, use a required checkout checkbox or written consent; redact names/chat in replays where possible.
7) Payments, fees, and taxes
- Payments are processed via WooCommerce/Dokan providers (e.g., Stripe/PayPal). Payout timing appears in your vendor settings.
- Platform Fee. CLIMB charges a clearly displayed market/platform fee per order, deducted before payout.
- Complete W-9 (US) or W-8BEN (non-US) before your first payout. You’re responsible for your taxes.
- Processor Disputes. If a payment is disputed/charged back, CLIMB may pause payouts and reverse amounts under processor rules. You agree to cooperate with evidence.
8) Refunds, cancellations, and no-shows
Each listing must show one policy:
- Standard: ≥7d 100% • 2–6d 50% • <48h no refund. One transfer if requested ≥48h.
- Strict: ≥14d 100% • 7–13d 50% • <7d no refund.
- Digital: no refunds once files/replays are accessed.
Delays: If a Freelancer misses a delivery date without prior notice, Client may request a reasonable extension or a proportionate partial refund. No-shows: If the Client misses a live session without timely notice, the session may be marked completed under the chosen policy.
9) Milestones & acceptance
Large projects may be split into milestones with partial approvals and payouts. Work is accepted when the Client approves in writing or after 7 days with no dispute, unless the listing says otherwise.
10) Revisions
State how many rounds of revisions are included and what qualifies. New features or out-of-scope requests require a new quote/order.
11) Intellectual property & licenses
- Before payment: Freelancer owns drafts/work product.
- After payment: license or assignment transfers as stated on the listing (e.g., personal/non-exclusive/commercial/full assignment).
- Clean IP: Freelancer warrants rights to materials supplied and will remove/replace infringing content if notified.
- Photo & Content Rights: Images and descriptions belong to their makers. Reuse without permission is not allowed. Upload resized images only (1500–2000 px wide).
- Portfolio use: Unless the listing or an NDA says otherwise, Freelancer may show non-confidential images after delivery. Client may opt out in writing. Redact private data in portfolio items.
12) Confidentiality, NDA & non-circumvention
- Treat shared information as confidential unless permission is given.
- NDA option: If needed, attach an NDA to the listing or order before work begins; conflicting NDA terms control that topic.
- 12-month non-circumvention: For 12 months after first contact on CLIMB, don’t bypass the platform to avoid fees for substantially similar work with the same counterpart, unless CLIMB approves in writing.
13) Safety, inclusion, minors & prohibited conduct
- No harassment, hate, spam, or deceptive practices.
- Include safety notes if work involves tools/heat/chemicals.
- Minors & sensitive topics: Additional permissions, age checks, or supervision may be required; CLIMB may deny or remove such listings.
14) Ratings, feedback & badges
Reviews must focus on work and professionalism. We may remove reviews that include hate speech, doxxing, threats, or unrelated personal info. GamiPress badges are recognition only and don’t change legal status or fees.
15) Referrals & disclosures (AffiliateWP)
Disclose affiliate relationships when using referral links. No spam or incentivized reviews.
16) Data, privacy, emails & retention (WP Fusion + AC)
We use tags/automations to run essential emails (orders, reminders, follow-ups). See our Privacy Policy. Retention: project files/messages are retained while the order is active and for up to 24 months for support/audit, then deleted or archived (where lawful). You may request earlier deletion where legally permitted.
17) Compliance
You represent you’re not in an embargoed country nor on restricted lists, and you won’t use CLIMB for prohibited end uses.
18) IP takedowns
Report alleged infringement at /ip-report with URLs and proof. We may remove/disable access and notify the other party to respond.
19) General
- Force majeure: No liability for delays caused by events beyond reasonable control (e.g., outages, disasters). Obligations resume once the event ends.
- Precedence: If these Terms conflict with payment-processor rules or non-waivable consumer laws, those apply to the extent of conflict.
- Governing law & venue: These Terms are governed by the laws of [Your State/Province]. Venue: courts of [County, State/Province], unless otherwise required by law.
